Tax Audits
Under the current administration, we expect that the number of audits will substantially increase.
A tax audit is often a confusing and intrusive experience. We carefully guide our clients through the entire tax audit process. If your audit results in an additional assessment, the tax attorney and enrolled agent at our firm can assist you in resolving your liability.
The IRS conducts both in-person audits and correspondence audits. In general, in-person audits tend to be more involved and time-consuming, but it is equally important to have competent, experienced representation to assist with both types. We are happy to schedule a consultation to determine how we can assist you in resolving your audit.
Tax Appeals and Tax Court Petitions
Our experienced tax law team can assist clients with matters that require court resolution, including tax appeals and U.S. Tax Court Petitions. They include:
Refund Claims: If you believe that you are entitled to a refund from the Internal Revenue Service, contact our office to schedule a consultation. You may be able to request a refund of overpayments as well as an abatement of penalties and interest under certain circumstances.
Collection Appeals: In the event that the IRS has taken collection action against you, such as filing a tax lien or tax levy, filing a collection appeal may be appropriate. We can schedule a consultation to determine if a collection appeal may benefit you.
Collection Due Process: A due process appeal is typically warranted when the IRS has taken collection action against you, such as filing a tax lien or levy, without responding to your reasonable requests to resolve your tax liability. To determine whether a collection due process appeal is appropriate for you, please contact our office.
Tax Court Petitions: If you have received a Notice of Deficiency from the IRS, there is a non-negotiable, non-extendable, finite time limit to file a petition with the U.S. Tax Court in order to protect your rights. We can help you determine when it is appropriate to seek such relief; we can prepare your petition, and file it electronically with the United States Tax Court.
Innocent Spouse/ Injured Spouse
If you file jointly with your spouse and the IRS adjusted your tax return due to unreported income solely of your spouse, or your spouse signed the joint return without your knowledge or consent, then you may qualify for innocent spouse relief.
If your federal tax refund was applied towards your spouse’s balance for which you are not obligated, you may be entitled to injured spouse relief.
If you believe you may qualify for innocent spouse relief or injured spouse relief, you should speak with an experienced local tax attorney or enrolled agent as soon as possible. You have a limited amount of time to request either form of relief, so act immediately.
Foreign Account Holdings
The Foreign Account Tax Compliance Act (FATCA) imposes reporting requirements on U.S. individuals, resident aliens, and businesses with foreign financial interests, as well as on certain foreign entities. Created to reduce offshore tax fraud and evasion, it compels U.S. taxpayers to disclose offshore accounts or face severe penalties, fines, tax liabilities and possible criminal prosecution.
We have helped several clients with regard to their foreign financial holdings.
